The MYSAFERIDEHOME® Service Card Terms of Use Agreement

IMPORTANT - PLEASE READ: The following agreement describes the terms and conditions that govern the use of your MYSAFERIDEHOME® (MSRH) cards in jurisdictions that MMC Software International Corp.; its non profit organization, the Aislinn Education & Safety Foundation; its affiliates; and the Licensees who operate our business model, Trademarked as the MYSAFERIDEHOME® (hereafter collectively, "MSRH").

By using your MSRH, you agree to the terms and conditions of this agreement. Please keep a copy of this agreement for your records. The terms and conditions of this agreement will govern the use of the MSRH card by you or anyone else that holds or uses the MSRH service card.

About The MYSAFERIDEHOME® Program:
The MYSAFERIDEHOME® program looks to provide a safe ride home for all of its respective cardholders. Key to our program is our ‘Risk- Intervention-Service’. The goal is to pick up an individual, removing them from a risky, threatening or dangerous situation as quickly as possible. By engaging the participation of local taxi service providers, this unique risk intervention program accesses literally tens of thousands of vehicles and drivers on the road 24/7 to provide this valuable service. We select our taxi fleets based on a set of criteria that can provide the best possible service. Our priority objective is to remove the consumer from any potentially harmful situation followed by the provision of a safe ride home.
The program has not been developed to utilize this service as a simple means of acquiring a priority or quick pickup service for general use. This is a Risk Intervention Program and respectfully shall be managed as such.
Zone Rates
In establishing an appropriate Zone Rate for a specific city/ region or geographic area, the business model looks at thousands of actual existing taxi fares and determines an appropriate Zone Rate relevant to the desired area of use.  This rate, which when considered as an average, will provide a safe ride home for the majority of our consumers. However, it is noted in some situations the time and distances traveled may exceed any reasonable expectation to fully compensate the program for the service provided. Please review Ride Credits and Maximum Redemption Value of a Ride Credit below. Our Zone Rate Structure may provide for two or all three of the following Zone Rates: Safe Zone; Local Zone; & Comfort  Zone:

Definitions:

  • Local Zone – established primarily as a short distance model for areas in which you may only require a very short ride such as a downtown core or other localized area.
  • Safe Zone –established as our primary Zone in which the majority of residents would find themselves able to receive a ride home with no extra charges
  • Comfort Zone – allows a cardholder to extend the coverage area of a Safe Zone.  Comfort Zone Credits may only be utilized to extend the value of any Safe Zone regardless of the value of a particular Safe Zone.  Comfort Zone(s) may not be applied to extend that of a Local Zone

 

Ride Credits
Ride Credits are valued and purchased around representative Zone Rates for the area of intended use. Ride credits reside on the MYSAFERIDEHOME card and are redeemed when an individual requires a ride from a participating taxi company in areas where the MYSAFERIDEHOME program is active. As identified above all cards are required to have a minimum of at least one Safe Zone Ride Credit available for use at any time to maintain active use status. When you reach your destination, simply hand the driver your MSRH Card. The taxi driver will swipe your card to redeem one ride credit in exchange for the taxi ride provided the fare is within the maximum redemption value of a ride credit (see below).
Should a ride credit or credits remain on a card for a period  I year (365 days) from the date of purchase or the last date a ride credit was utilized, whichever is the latter, a maximum of one ride credit, per card, per year shall be considered non-redeemed and is refunded to the program.
An individual may purchase multiple ride credits of equal value or should he /she desire to have the benefits of the MYSAERIDEHOME program while travelling, they may purchase ride credits for other Zones if available.
An individual must have a ride credit of equal or greater value for the applicable Zone Rate representative of the area of use in order to benefit to the fullest value of the MYSAFERIDEHOME program.
Please note that gratuities are not included in the Ride Credit. If an actual fare is lower than a particular ride credit value, the difference is utilized to balance out when the fares may possibly be higher. The driver does not benefit from this process. Your appreciation of their service in removing you from a possible risky situation and providing you a safe ride home, by providing a gratuity for the driver is encouraged and much appreciated.
If you have registered your card and created an account, you can log in to check how many Ride Credits you have on your card and add Ride Credits and Ride Credit “top ups” as required.

Maximum Redemption Value of a Ride Credit
The business model recognizes there are residents who may live on the outskirts of a specific city/ region or geographic area representative of a particular Zone Rate.  Or an individual may find he/she may require a ride from a location which may be at the opposite side of town or farthest distance from their desired destination. Both situations would see the cost of a taxi ride home greatly exceeding the average rate currently covered by the ride credit for the selected Zone. They may also live in a neighbouring community which may not have an established MYSAFERIDEHOME program and find themselves in need of a safe ride home from a participating community. .
As an averaging program the current business model shall provide a ride home at no additional cost to a maximum redemption value of 25% above the ride credit value*. For example, this would represent a value of $37.50 for MYSAFERIDEHOME ride credit on a card having a single credit value of $30.00.
For all fares exceeding the set maximum, the cardholder shall be responsible for the balance outstanding. Should you believe your needs, due to expected travel distances and circumstances, will see your fare potentially or likely exceed the maximum redemption value, we have created a number of options available for your consideration;

  • Cardholder will agree any additional fare incurred, may be automatically charged to their credit card (or that of a parent or guardian if approved to do so) plus an administration fee of three dollars ($3.00).
  • You may pre-purchase top up credits in increments of ten dollars ($10.00) which will be redeemed as required to cover any overages.

Options A and B are ideal for ensuring a cardholder, who may not have either a personal credit card or generally carry sufficient cash,  shall have sufficient means of always receiving a safe ride home.

  • Cardholder may at time of use, pay by cash any additional fare incurred.
  • Cardholder may at time of use, pay by credit card any additional fare incurred plus an administration fee of three dollars ($3.00).
  • A second Ride Credit may be redeemed from the card if available.

*Provided the individual has a ride credit of equal or greater value for the applicable Zone Rate. The requirement of having an adequate applicable Zone Rate of Ride Credit Value relative to the area of use for a MYSAFERIDEHOME card is the responsibility of the cardholder.

With your support, we undertake to follow up in order to ensure the model is having the favorable results required in making our communities safer. Should you have needed and utilized the service provided with a MYSAFERIDEHOME card, we encourage you to share your story. Our website may provide for and include random surveys or opportunities for sharing your story. No interest, dividends, or any other earnings on funds deposited onto a MSRH cards will accrue or will be paid or credited to you by MMC Software International Corp., its operating Divisions, its affiliates and/or its Licensees. The value associated with the MSRH cards is not insured by either the Canadian Deposit Insurance Corporation (CDIC) or the Federal Deposit Insurance Corporation (FDIC).

Use of MSRH program is limited to participating Taxi Companies associated with our program. Where regulations allow for it all participating taxi fleets will bear our mark on back door vehicle windows.
We reserve the right not to accept, load, re-load or re-issue any MSRH card or otherwise limit the use of a MSRH card if we reasonably believe that the use is unauthorized, fraudulent, exploited for use other than risk intervention, or otherwise unlawful.

Registering your MYSAFERIDEHOME® Card

Once you have purchased your MYSAFERIDEHOME® Card, you can register it online at www.mysaferidehome.com  After you register your card, you will receive e-mails from us for purposes of managing your account or providing you services relating to your MSRH card, including confirmation of re-loads and verification of accounts.

Loading and Reloading Value on Your Card

You can load (or reload) Ride Credits, Top Ups, on the MSRH Card at the web links noted above, using an approved credit card. All MSRH Cards purchased at a participating store location come loaded with one [1] ride credit. The loaded amount will appear on your MSRH Card immediately (except for the Automatic Reload function - see details below). Currently, you may load one or more Ride Credits on your card. Each Ride credit purchased should be reflective and equal to the value and currency relative to the area of intended use (Zone Rate). A minimum of one Ride Credit equivalent to the prevailing ZONE RATE in which a  MYSAFERIDEHOME service was provided for shall be redeemed upon the delivery of the service. MMC Software International Corp. reserves the right to adjust the minimum or maximum amount that may be loaded onto your MSRH Card at any MSRH Card at any time in its sole discretion, and will post such changes online at www.mysaferidehome.com .

All amounts loaded onto your MSRH Cards are held and denominated in the currency of the country in which the MSRH Card is purchased for intended use (the "base currency"). MSRH Cards purchased in the USA for the use of the MYSAFERIDEHOME® service can be used in Canada on the condition on the basis that the “base currency” ZONE RATE for the respective Canadian MYSAFERIDEHOME® has been purchased on the customers MSRH card. Canadian MSRH cardholders can assure their MSRH card service is available to them while travelling in the USA, on the condition that they have purchased the appropriate ZONE RATE at the “base currency” of the USA and for the MYSAFERIDEHOME® jurisdiction they will be traveling to.

Automatic Reload

To make reloading your MSRH Card easier, you can use our Automatic Reload feature which is available for registered MSRH Cards. By linking an approved credit card to your MSRH Card, you can reload a dollar value onto your MSRH Card whenever you like. To set up Automatic Reload, you need to go online to www.mysaferidehome.com and click on the Reload Link and simply set up the reload frequency or the balance which you want to reload in your preferences profile, and then enter your payment information. Your credit card will be billed according to the schedule and amount you have selected. We will send you an email after each Automatic Reload purchase to let you know that you’re MSRH Card has been reloaded. Please note that reloads using Automatic Reload may take up to 48 hours to go into effect.

To discontinue your Automatic Reload feature, you must visit www.mysaferidehome.com or to disable the feature within 48 hours of the next scheduled reload. Once the dollar value is reloaded, the transaction cannot be reversed.

Fees and Expiration of Card Balances

MMC Software International Corp., and its authorized affiliates, do not charge any fees for the issuance, activation, or use of your MSRH Card ZONE RATE(s). Your MYSAFERIDEHOME® Card does not have an expiration date, so long as the card has an ‘Active’ ZONE Rate residing on the related “Ride Credit Purse”. When the last ride credit is used and if the card is not reloaded the card shall expire 365 from the last date of use.
The MMC/MYSAFERIDEHOME®  business model provides a stream of designated funds from a portion of non-used ride credits (one ride credit/per card/per 12 month period is refunded to the program if no ride credits are utilized by the cardholder with that 12 month period) are channelled in support of distributions to non-profit and institutional MYSAFERIDEHOME® accounts.

All charges related to either purchasing a MYSAFERIDEHOME® card, the activation or reloading of a MSRH card, when using a credit card or debit card to do so, will be subject to the charges the credit card holder has with his/her supplier.

Receipts and Statements

Cardholders are not sent statements of itemized transactions from a MSRH Card account. You can check the balance of your MSRH Card in online. You can review the most recent transactions on your registered MSRH Card at our website at www.mysaferidehome.com

Billing Errors, Corrections

We reserve the right to correct the balance of your MSRH Card account if we believe that a clerical, billing or accounting error occurred. We shall have no liability for any billing error unless you provide us notice within sixty (60) days of the date of the transaction in question. You should monitor your transactions and account balances closely.

Liability for Unauthorized Transactions

Because your MSRH Card is used for a pre-paid ZONE RATE, you are responsible for all transactions associated with your MSRH Card, including unauthorized transactions. However, if your registered MSRH Card is lost, stolen, or destroyed, it can be replaced with the balance remaining on it, but only if you have registered with us. If your MRSH Card becomes lost, stolen or damaged, you should notify us immediately online at www.mysaferidehome.com or by calling 1-888-909-6774 (MSRH). You must provide your card number and you will be asked certain questions concerning recent activity onyour account. Your MSRH Card balance is only protected from the point you notify us that your MSRH Card is missing and we are able to verify ownership of the card. We will freeze the remaining balance on your MSRH Card at the MSRH Card at the time you notify us and will load that remaining balance on a replacement MSRH Card. Replacement cards will be mailed within 3 business days of receipt of notice. A nominal shipping and handling fee of $5.00 will apply.

For information concerning how we collect, use and disclose information concerning the MSRH Card, you should refer to our privacy statement www.mysaferidehome.com.

Amendments to this Agreement

We may amend the terms or conditions of this agreement at any time, including any rights or obligations you or we may have. We will post the terms and conditions of the amended agreement on our web site at www.mysaferidehome.com or www.mysaferidehome.org. As permitted by applicable law, any amendment will become effective at the time we post the amended agreement on our web site or as otherwise stated in our notice to you. Unless we state otherwise, the amendment will apply to your future and existing MSRH Cards. You are deemed to accept the amendments if (1) you do not notify us to the contrary in writing within twenty (20) days of the date of our notice or such other time specified in the notice, or (2) you use your MSRH Card after such notice period. If you do not accept the amendments, upon written request, your MSRH Card will be cancelled and any amounts remaining on your MSRH Card will be refunded to you.

Suspension or Termination of this Agreement

We may suspend or terminate this agreement in whole or in part at any time and for any reason or no reason without notice or liability to you, including in connection with the termination of the MSRH Card program. If we terminate this agreement without cause, we will refund or issue ZONE RATE credits equal to the balance held in your MSRH Card account.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, notwithstanding any conflict of law rules.

Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS RIGHTS THAT YOU MAY OTHERWISE HAVE. IT PROVIDES FOR RESOLUTION OF MOST DISPUTES THROUGH ARBITRATION INSTEAD OF COURT TRIALS AND CLASS ACTIONS. ARBITRATION IS FINAL AND BINDING AND SUBJECT TO ONLY VERY LIMITED REVIEW BY A COURT. THIS ARBITRATION CLAUSE SHALL SURVIVE TERMINATION OF THIS AGREEMENT.

Binding Arbitration

This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of our relationship. Any dispute or claim made by you against us (or against any of our subsidiary, parent or affiliate companies) arising out of or relating to this agreement or your use of the MSRH Card (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration except that (a) you may take claims to small claims court if they qualify for hearing by such a court, or (b) you or we may choose to pursue claims in court if the claims relate solely to the collection of any debts you owe to us. However, even for those claims that may be taken to court, you and we both waive any claims for punitive damages and any right to pursue claims on a class or representative basis.

Arbitration Procedures

You must first present any claim or dispute to us by contacting our Customer Service Department to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within sixty (60) days. The arbitration of any dispute or claim shall be conducted in accordance with the Arbitrations Act (British Columbia) as modified by this agreement. Unless you and we agree otherwise, any arbitration will take place in Vancouver, British Columbia and will be conducted in the English language. An arbitrator may not award relief in excess of or contrary to what this agreement provides, order consolidation or arbitration on a class wide or representative basis, or award punitive damages or any other damages aside from the prevailing party's actual damages, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute. Any arbitration shall be confidential, and neither you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, than the remainder shall still be given full force and effect.

Costs of Arbitration

All administrative fees and expenses of arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.

Waiver of Punitive Damage Claims and Class Actions

By entering into this agreement, both you and we are waiving certain rights to litigate disputes in court. If for any reason this arbitration clause is deemed inapplicable or invalid, you and we both waive, to the fullest extent allowed by law, any claims to recover punitive or exemplary damages and any right to pursue any claims on a class or consolidated basis or in a representative capacity.

Disclaimers and Limits of Liability

MMC Software International Corp. (MMC) MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE MSRH CARD, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF SERVICE OR MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, OR ANY WARRANTY ARISING BY USAGE OF TRADE, COURSE OF DEALING OR COURSE OF PERFORMANCE. SOME PROVINCES/STATES/JURISDICTIONS DO NOT ALLOW THE LIMITATION OF IMPLIED WARRANTIES, SO THIS MAY NOT BE APPLICABLE TO YOU. DOES NOT REPRESENT OR WARRANT THAT YOUR MSRH CARD WILL ALWAYS BE ACCEPTED OR THE MSRH CARD PROGRAM WILL ALWAYS BE ACCESSIBLE. IN THE EVENT THAT MMC OR ITS AFFILIATES ARE FOUND LIABLE TO YOU, YOU SHALL ONLY BE ENTITLED TO RECOVER ACTUAL AND DIRECT DAMAGES AND SUCH DAMAGES SHALL NOT EXCEED THE LAST BALANCE HELD ON YOUR MSRH CARD PRIOR TO THE SUCH DAMAGES ARISING. MMC AND ITS AFFILIATES SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFIT, REVENUE, USE OR DATA) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS AGREEMENT, WHETHER IN CONTRACT (INCLUDING FUNDAMENTAL BREACH), WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, EVEN IF WE OR OUR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL MMC OR ITS AFFILIATES HAVE ANY LIABILITY FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF A MSRH CARD THROUGH ACCIDENT, MISUSE, OR FRAUDULENT MEANS OR DEVICES BY YOU OR ANY THIRD PARTY, OR AS A RESULT OF ANY DELAY OR MISTAKE RESULTING FROM ANY CIRCUMSTANCES BEYOND OUR CONTROL. SOME PROVINCES/STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

Assignment

We may assign all or part of this agreement without notice to you. We are then released from all liability. The assignee shall have the same rights and obligations as the assignor and shall agree in writing to be bound by the terms and conditions of this agreement.

Entire Agreement

This agreement is the complete and exclusive statement of agreement between you and MMC Software International Corp. and its Affiliates, and supersedes and merges all prior proposals and all other agreements. In the event that any provision of this agreement shall be determined to be illegal or unenforceable, that provision will be eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect and enforceable. Headings herein are for convenience of reference only and shall in no way affect interpretation of this agreement.
